If you have a choice of LOA, you should go ahead and take it.

RFE is not a must - if you do get a RFE, it need not be necessarily for paystubs. You should take LOA, start your job search and try to get a similar position asap and if you do get RFE, you will have a choice of going with AC21 or not depending on your RFE.

Dont think that you will get your GC in a month or so - this process is very unpredictable and the more you be prepared for it, the better it is.

Best of luck and hope you get your GC soon.

    Here is my situation:

    - I have a valid H1B and EAD through Employer A. My current status is H1B.

    - I am getting offer from Employer B but they are asking me to join on EAD so that I dont have to wait for H1 Trasnfer approval. They are okay in filing for H1 B Transfer at the same time. Here are 2 questions I have:

    1. In case H1 transfer gets denied then will I be able to go back to Employer A and continue on the current H1B ? I really dont want to take the risk of using EAD since if I-485 is denied then I will have to leave immediately.

    2. Will I be able to maintain my H1 B status even if I join on the basis of EAD considering that H1 B transfer application is filed before I join.

Your answer will be very helpful for me to take the right decision.

    Thanks in Advance

Here are a bunch of links showing abuse of some of us H1Bs.

In short Tata was requiring H1B employees to sign over tax refunds to them. It also appears that Tata ensured that taxes were overpaid to ensure that there was plently of refund for them to blackmale employees out of.

Sounds to me like a case of criminal fraud by Tata.

I was hired for a position that required Masters and I fortunately was in EB2, but a colleague of mine, who is doing the similar work, was put in EB3 because his manager created the position with a requirement of Bachelors. He had a Master's degree. Here employee suffered because of his manager's ignorance

Wouldn't say it is ignorance on the part of the manager. Ignorance is easily abated by the employee talking to the manager. Plus any good lawyer will ask the manager if a master's degree is required for the job before proceeding with recruitment.

More often there are other reasons such as ego issues ("I don't have a college degree so why does my report need a master's degree") or practical difficulties (necessity to raise the wage offered) that can cause an otherwise qualified person to be classified as EB3.

In the article. It also says that

It isn't clear, however, whether the immigration agency will now accept all applications and process them later, accept only those that have arrived, or come up with some other approach."

    So, we don't know...

I renewed my passport from Indian SF consulate by mail. I had send my passport in Aug 2010 with Notarized supporting documents like photocopies of driving license and H1B. I did not notarize passport photos. I got my passport back after 5 weeks without any problem. Hope this helps.

Wall Street Journal has a article about the Greenspan's testimony. The comments seem to be taken over by the anti's. Please comment if you can.

Best way to get your points across is by Writing to Fawn Johnson at and the editors. There are going to be thousands of comments and nobody will have time to go through them. But someone will definitely read your emails.

Do mention about immigrationvoice so that the reporter can come to our site and us for more information. No point posting comments and engage in nasty comment war with antis. You cannot change their ugly mindset no matter how well you try to explain. These over the hill racist nutjobs have nothing else to do in life than spend their time on such sites to post their comments. Rather than learn new technologies, upgrading their skills, innovate or start new companies they waste their time in xenophobic agenda. They are just afraid of competition and unwilling to work hard.

So write emails and put in effort where you will get more benefits.

Dude, if you find it difficult to digest, then don't do it with your kid. Its that simple.
A debate on this is probably not warranted, as its subjective to every individual's situation.

And btw, both my kids live with me, but they travelled with someone else to spend their vacation at grand-parent's house, so I am not trying to oppose your viewpoint.

I was also lucky to meet one of their executive editors to whom I explained the issues posed by retrogression. He was very supportive but informed that he has been hearing from the other side as well.( I guess from NumbersUSA).
We too should be pro-active in campaigning to media about our valid cause.

I just sent the following E-mail to the Information Week Editors.
Sub:Your help requested for Skilled IT wokers to get their greencards
    Dear Mr.McGee,

I had a chance to read your article about the issues
faced due to the H1B caps and the Greencard
Retrogression.("Time Is Running Out For H-1B Visa Cap
    To Be Raised--Or Is It?"-Information

Thanks much for your insight about the SKILL bill.

It would be of great help if you could write more
Articles about the retrogression issues. Thousands of
unfortunate skilled workers like me have been caught
in the 'Retrogression' black hole and there is no
relief is visible in any near future.I have been
waiting for more than 5 years for my green card in
vain. We are in a state of limbo and are almost
similar to bonded laborers since our professional
    mobility is very much limited.

People talk so much about the CIR and Illegal aliens
but very few people even know about the plight of the
LEGAL SKILLED workers. The retrogression has not only
affected my immediate future but it has also
negatively impacted the future of family/kids as well.

Our final hope is residing on the SKILL Bill and we
pray that it will be some how be passed in the
lame-duck session as you mentioned in your article.
Hundreds of Skilled workers like me have given up hope
already and are returning to their countries or are
looking for opportunities in other countries like
Canada etc. This also is having a significant negative
    impact on US economy.

Just to give an example: Atleast 100,000 Skilled
workers are holding off the decision to buy a house
since they are not sure about their future here in US.
This amounts approximately to $30,000,000,000 (100000
X $300,000) inflow of money that could give a big
boost to the declining US Housing market.

It is sad to see that so many experienced LEGAL people
leaving this country due to immigration caps.

I kindly request you to publish a cover story on this
serious issue before the lame-duck session. I am sure
your words will have a big impact on the CEO's and
CIO's who in turn can lobby among the senators for our

Thanks again for your help so far.

[I apologize for starting a non-immigration related thread on this personal question.] I am trying to quickly book a US-India Lufthansa flight via Frankfurt for June travel, and the one I am looking at gives me 2-hr stopover (+30mins for boarding) at FRA in between connections, in the same terminal, on the return leg of the trip. My question to those of you who recently traveled via FRA is whether 2-hr is long enough to make the connection. I haven't had such a trip in a while, and not up-to-date with any additional (passport/immigration) verification procedure at this airport. I do know FRA does not require a transit visa.

Thanks a bunch for your time.

    That makes perfect sense.

My question is - Is it possible that all clauses related to illegal immigration will be striked off, while legal will go through? To my understanding, the main objective of this bill is to solve the issue of illegal immigration. Legal immigration is just an additional section.. My fear again is - will the whole bill be discarded just because of the contentious illegal immigration aspects in the bill?.. Is there a way to pass the legal immigration relief measures without a bill?.. something like an amendment to the existing law?

Thanks for taking the interest and posting the comment.

What you mean is change the content of the webfax, not the format.

Anyways, the current draft of Specter bill would lead to numbers flowing downward(unused numbers due to 7% or 10% per country limit). When they flow downwards from EB2, EB3 and EB4, they go to EB5 where there is no mention of per country limit(by omission).

You know what this means? After all the gains, the country limit on India and China will cause the overflow of all visa numbers to EB5(Unskilled labor, gardeners, cooks, maids) WHERE THERE IS NOT COUNTRY LIMIT and unlimited demand. And over there, in absence of no country limit, immigrants from Mexico will consume all EB5 unskilled numbers and there wont be anything like "UNUSED" numbers.(read the thread posted by STUCKLABOR for that analysis and legalese. : )

Coming back to proposals of Specter, the idea that there is so much relief that we dont need to worry about this or is the thing...Current markup is a proposal. Not even a final version of Judiciary committee markup. From there you lose some things when it goes to the full floor of senate and then A LOT OF THINGS when the hawks from the HOUSE of REPS like Tancredos and Smiths slither their tentacles on the Senate version in the CONFERENCE COMMITTEE. That's the reason we dont want to lose one thing even if we are gaining 10 things because those 10 things might be reduced to 2 by the time its negotiated in the conference committee between the house and the senate.

However, if you want to provide more input on this issue, you are most welcome to email Sandeep who is leading the content-prep team that writes these webfaxes and letters. His email is

Thanks for taking interesting and sharing your view.

I dont know about other IT like SAP etc, but software and hardware majors like Microsoft, Intel , Cisco, Yahoo, Google are facing tremendous shortage of skilled labor. For eg:

My wife recently graduated in CS. At the career fair, if the companies declared they wanted to get resumes only from Citizens and GC holders, their booths were empty and were waiting for people to turn up to them. If they allowed F1 students, there used to be a big queue and even the citizens were happy to be part of the queue. Bottomline is in addition to skills its also company culture. Companies that dont discriminate by visa types grow faster and have better work cultures.

Also in a graduating class of 100 people, there were barely 5-6 white or african american citizens, 5-6 Iranians, 5-6 others, rest were Indians and chinese in ratio of 60 to 40 pecent.

When it comes to PhDs there were suprisingly again higher number of US citizens and chinese but very few indians which led me to think that americans go for higher education in very small numbers or their number is small in graduate school but they go all the way up and complete PhD. Where as most Indians and chinese drop out after MS which is good but not really innovative research.

    07-01 01:51 PM
Now matter what , no other country has balls or guts to accept huge number of immigrants like US does, yes do you huge volume it is slow but the govt. is more aware of the fact that high skilled immigrants add to the benefit of their country compared to Canada (conservatives in liberal skin- because they have undocumented race based limitation), Britian(high skilled immigrants are usually colored therefore anything colored is considered not British) and Australia (how can a decent high skilled immigrant be accepted by bunch of outback thugs).

Please observe all these countries' immigration policies in this day of economic downturn, all of them are actively shutting their doors except USA (comparatively). I think USA is more closer for me as a home after India, I got misled by Canada but after what happened in their Alberta Province's AINP program for H1b holders I realised that Canadian pasture is really not green it is just an illusion.

I think my question is: is it possible for USCIS to review the case and change the decision they made after approval? Thanks.
